Terms of Service

1. Who can use Waygerz

You must be at least 18 years old and legally able to enter this agreement. Waygerz is intended for use in the United States. You’re responsible for complying with the laws that apply to you.

2. Waygerz is play-money — not gambling

Waygerz is a social sports pick’em and head-to-head game played with virtual “credits.” Credits have no monetary value, cannot be purchased, and cannot be redeemed, withdrawn, or exchanged for cash, prizes, or anything of value. Waygerz is for entertainment among friends only and is not a real-money wagering, betting, or gambling service. You may not use the Service to place, broker, or settle real-money bets.

3. Your account

You sign in with your mobile phone number and a one-time code. Keep your device and number secure — you’re responsible for activity under your account. Provide accurate information, keep it current, and don’t impersonate anyone or create an account for someone else. One account per person.

4. Leagues, picks, and wagers

• Leagues are created and run by their members. A commissioner may set rules, invite or remove members, schedule weeks, and moderate content.
• Picks and head-to-head wagers use play-money credits only, and are settled based on real-world sports results.
• Sports schedules, odds lines, scores, and results come from third-party data that may be delayed, incomplete, or incorrect. We don’t guarantee its accuracy and aren’t liable for settlement outcomes based on it.
• We may correct obvious errors, void picks affected by data problems, or reverse settlements to keep play fair.

5. Acceptable use

You agree not to:

• use the Service for any unlawful purpose, including real-money gambling;
• harass, threaten, defraud, or abuse other users;
• cheat, exploit bugs, manipulate results, or use bots or automated access;
• post content that is illegal, infringing, hateful, or obscene; or
• interfere with, reverse-engineer, or attempt to gain unauthorized access to the Service.

6. Text messages (SMS)

By providing your phone number and agreeing at sign-up, you consent to receive text messages from Waygerz. This includes account and service messages (such as one-time sign-in codes, bet challenges, results, and reminders), and — only if you separately opt in — promotional messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. Opting out of marketing messages does not stop essential account and security messages, including one-time sign-in codes. See the Privacy Policy for how we handle your number.

7. Your content

You keep ownership of the content you post (messages, names, images). You grant Waygerz a non-exclusive, worldwide, royalty-free license to host, display, and use that content as needed to operate the Service. Don’t post content you don’t have the right to share.

8. Termination

You may stop using Waygerz at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including disclaimers, liability limits, and indemnification) will survive.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, secure, or error-free, or that sports data will be accurate.

10. Limitation of liability

To the fullest extent permitted by law, Waygerz and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service. Because Waygerz uses no-value play-money credits, our total liability for any claim is limited to [amount, e.g. USD $100].

11. Indemnification

You agree to indemnify and hold Waygerz harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll take reasonable steps to let you know. Your continued use after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Florida, unless applicable law requires otherwise.
